What Khalil said about establishing Khilafa
قال خليل: لما كان الإنسان لا يستقل بأمور دنياه، إذ لا يمكن أن يكون حَرَّاثَاً طَحَانَاً خبازاً إلى غير ذلك من الصنائع المفتقر إليها، احتاج إلى غيره، ثم بالضرورة قد يحصل بينهما التشاجر والخصام لاختلاف الأغراض؛ فاحتيج إلى من يفصل تلك الخصومات، ويمنع بعضهم من غرضه، فلهذا وجب إقامة الخليفة، لكن نظر الخليفة أعم إذا جد ما ينظر فيه القاضي، ولما كان هذا الغرض يحصل بواحد وجماعة كان فرض كفاية.
Seeing that the human being cannot be independent in all of his affairs, he cannot be a farmer, a grinder, and a baker, among all the other things he needs. He is in constant dependence on others. By necessity then, disputes will emerge amongst them, and they will need someone to judge between them, and restrain each other from oppression. Due to this, the establishment of the khalifa is necessary, for the expanse of the khalifa is broader than that of a judge. This end can be reached by one individual and a group, and hence it is a communal obligation.
