Does Touching The Opposite Gender Break Wudu’ in Maliki Fiqh?

Question: Does touching the opposite gender break wudu’?

In the Name of Allah, the Most Beneficent, the Most Merciful.

If one touches the opposite gender, from one who you would normally find (sexual) pleasure from, either intending pleasure, or finding it, then it breaks your wudu’.

If you touch someone of the opposite gender, but they are not normally taken pleasure from: such as a female family member (mahram), then this would not break your wudu’.

If you touch the opposite gender from a woman such as your wife or a non-related woman, then your wudu’ is broken in three out of four scenarios:

  1. Touched her intending pleasure and you found pleasure: your wudu’ is broken.
  2. Touched her intending pleasure but did not find it: wudu’ is still broken.
  3. Touched her without intending pleasure but accidentally found pleasure: wudu’ is broken.
  4. Touched her without intending pleasure and did not find pleasure: wudu’ is not broken.

What is meant by (sexual) pleasure? It is hard to define but one can approximate it to be an internal excitement such as the quickening of the heart beat.

What is meant by touching? As Imam Khalil says, the touching includes any part of her body, including her hair, nails, and even it if were covered by a barrier.

(وَ) النَّوْعُ الثَّانِي (لَمْسٌ) مِنْ بَالِغٍ لَا مِنْ صَغِيرٍ وَلَوْ رَاهَقَ وَوَطْؤُهُ مِنْ جُمْلَةِ لَمْسِهِ فَلَا يَنْقُضُ وَإِنْ اُسْتُحِبَّ لَهُ الْغُسْلُ كَمَا سَيَأْتِي (يَلْتَذُّ صَاحِبُهُ) وَهُوَ مَنْ تَعَلَّقَ بِهِ اللَّمْسُ فَيَشْمَلُ الْمَلْمُوسَ (بِهِ عَادَةً) خَرَجَ بِهِ الْمَحْرَمُ عَلَى قَوْلٍ وَسَيَأْتِي لِلْمُصَنِّفِ وَخَرَجَ الصَّغِيرَةُ الَّتِي لَا تُشْتَهَى وَغَيْرُ الْأَمْرَدِ مِمَّنْ طَالَتْ لِحْيَتُهُ وَجَسَدُ الدَّوَابِّ فَلَا نَقْضَ فِي الْكُلِّ وَلَوْ قَصَدَ وَوَجَدَ

(وَلَوْ) كَانَ اللَّمْسُ (لَظُفْرٍ أَوْ شَعْرٍ) أَوْ سِنٍّ مُتَّصِلَةٍ لِأَنَّ الْمُنْفَصِلَ لَا يُلْتَذُّ بِهِ عَادَةً وَدَخَلَ فِي كَلَامِهِ الْأَمْرَدُ مَنْ نَبَتَ عَذَارَاهُ، فَإِنَّهُ يُلْتَذُّ بِهِ عَادَةً (أَوْ) كَانَ اللَّمْسُ فَوْقَ (حَائِلٍ) وَظَاهِرُهَا الْإِطْلَاقُ (وَأُوِّلَ) الْحَائِلُ (بِالْخَفِيفِ) أَيْ حُمِلَ عَلَيْهِ وَهُوَ الَّذِي يَحُسُّ اللَّامِسُ فَوْقَهُ بِطَرَاوَةِ الْجَسَدِ بِخِلَافِ الْكَثِيفِ (وَ) أُوِّلَ (بِالْإِطْلَاقِ) أَيْ وَلَوْ كَثِيفًا إبْقَاءً لَهَا عَلَى ظَاهِرِهَا وَمَحَلُّهُمَا مَا لَمْ يَضُمَّ أَوْ يَقْبِضْ بِيَدِهِ عَلَى شَيْءٍ مِنْ الْجَسَدِ وَإِلَّا اُتُّفِقَ عَلَى النَّقْضِ (إنْ قَصَدَ) صَاحِبُ اللَّمْسِ مِنْ لَامِسٍ وَمَلْمُوسٍ بِلَمْسِهِ (لَذَّةً) وَجَدَهَا أَوْ لَا (أَوْ) لَمْ يَقْصِدْ وَ (وَجَدَهَا) حِينَ اللَّمْسِ لَا إنْ وَجَدَهَا بَعْدَهُ مِنْ التَّفَكُّرِ وَلَا يَنْقُضُ وَلَا يُشْتَرَطُ فِي اللَّمْسِ أَنْ يَكُونَ بِعُضْوٍ أَصْلِيٍّ أَوْ لَهُ إحْسَاسٌ بَلْ مَتَى قَصَدَ أَوْ وَجَدَ وَلَوْ بِعُضْوٍ زَائِدٍ لَا إحْسَاسَ لَهُ نُقِضَ بِخِلَافِ مَنْ مَسَّ بِعُودٍ أَوْ ضَرَبَ شَخْصًا بِكُمٍّ قَاصِدًا اللَّذَّةَ فَلَا نَقْضَ (لَا) إنْ (انْتَفَيَا) أَيْ الْقَصْدُ وَاللَّذَّةُ فَلَا نَقْضَ
